2. Collection and Use of Personal Information.

Personal Information You Provide:

– Registration Information: In order to enable your registration for the Service, including any subscription plans, and to facilitate Service administration and security, including providing you with messages, notifications and alerts relating to the Service and with customer support, we may collect your name, email address, shipping address, billing address, contact phone number, username, password and similar identifiers.

– Participatory Information: In order to facilitate the personalization of your use of and participation in the Service, we may collect your answers to questions about a variety of topics, including your experiences, feelings, opinions and goals through sharing within the group and through coursework. Your contribution of Participatory Information is entirely voluntary, and we will only collect Participatory Information if and to the extent you choose to provide it.

– Payment Information: In order to facilitate payment processing and recordkeeping, we may collect payment information and details of transactions you carry out through or in relation to our Service (such as payment of subscription fees) and of the fulfillment of your orders. From time to time, we may engage a third-party payment processor to collect your payment information and process payments relating to the Service, in which case such third party’s collection and use of your payment information is governed by the third party’s own privacy policy, which will be identified for you at the time of payment submission.

Automatically Collected Usage Data:

Like many websites and apps, our Site uses server logs, cookies and similar automated tracking technologies to help us analyze how users interact with Energy Think and improve our Service. The information we collect automatically includes information about your computer or mobile device and internet connection (including your IP address, operating system and browser type) and details regarding your use of the Site.

To facilitate such collection, our Service uses web analytics services such as Google Analytics. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google’s privacy policies, which can be viewed by clicking here. Additional Uses of Personal Information:

In addition to the specific uses identified above for Registration Information, Participatory Information, Payment Information and Usage Data, we may use your personal information to: provide you with information, products or services that you request or that we are otherwise contractually obligated to provide; provide you with support; complete transactions (including sending invoices and collecting payments); comply with our legal and security obligations with respect to operating the Service; personalize and continually improve the Service; market our products and services; perform statistical, demographic and marketing analyses of users; and facilitate our other legitimate business purposes, including managing our security obligations with respect to the Service, complying with applicable laws and regulations and protecting the rights, property or personal safety of users, us or the public.

3. Sharing of Personal Information

We may share your personal information: (i) with contractors, service providers and other third parties we use to support our business, in particular providing payment processing, data hosting, infrastructure and analytics services; (ii) for Participatory Information specifically, with other users, provided that such sharing will only be in ways that are readily apparent to you from the circumstances (e.g., where you volunteer to share personal information in front of other attendees of an Energy Think program); (iii) to fulfill any other purpose disclosed by us when you provide the information or consented to by you (including where you consent to the recording of sessions); (iv) with our affiliates or any successor to all or part of our business; (v) in order to comply with a subpoena, court order, or applicable law; and (vi) in order to protect the rights, property or personal safety of users, us or the public.

4. Your Choices and Rights.

You have choices and rights with respect to how we collect and use your personal data.

Rights and Requests: You can contact us at any time using the contact information listed in the last section of this Privacy Policy to request we do any of the following: (i) erase or delete all or some of your personal information; (ii) change, update, or correct your personal information; (iii) restrict how we use all or some of your personal information; (iv) access your personal information and, where applicable and feasible, request to receive that personal information in a commonly used electronic format (or ask for this information to be provided in that format to a third party); or (v) disclose what personal information we collect, use, disclose, or sell. We will consider and respond to any such requests promptly, and otherwise in accordance with applicable laws. Although we use good faith efforts to respond to your request, we may not be able to provide, delete and/or correct the requested user information in all situations. For example, we may not be able to provide the personal information requested if it imposes an undue burden or expense, requires us to release confidential commercial information, requires the disclosure of personal information relating to another person, or requires authentication of the request that is not feasible. Similarly, where you have consented to the recording of sessions, we may archive and continue to use such recordings as part of the Service, and will not typically delete such recordings based on a user’s request except in exceptional circumstances.
California residents should also review the additional information applicable to them in the section that follows.

If you are a resident of California, this section applies to you and supplements the rest of this Privacy Policy, to the extent the California Consumer Privacy Act (“CCPA”) applies to your interactions with Energy Think.

We collect, use and disclose personal information as described above under “Collection of Personal Data” and “Use and Disclosure of Personal Data.” We do not sell personal information.

You may, by using the contact information listed in the last section of this Privacy Policy, submit a request to know/access or delete. Should you submit such a request, we may ask you for additional information in order to verify your identify before responding to such requests, but we will use such additional information only for purposes of such verification. You may also use an authorized agent to exercise your rights on your behalf. If you wish to use an authorized agent, we require that your authorized agent provides written proof to us that they are authorized to act on your behalf, and we may also require your authorized agent to verify their own identity.
